Clay Cross PSPO.
As many of you are aware there is a Public Space Protection Order in place that covers Clay Cross, Holmgate and Danesmoor.
On Friday, Officers from your local SNT dispersed 6 youths that were causing ASB near Home Bargains and McDonalds.
This PSPO gives police the powers to give a direction to any individual who appears aged 10 years or over who is in a public place to leave an area. This direction will prohibit an individual from returning to the excluded area for a 24 hour period. The aim of the power is to minimise the likelihood of antisocial behaviour, crime or disorder arising and/or taking place.
When dispersed the individual will be issued with a map of the exclusion area. Upon dispersal, officers may also request you to surrender any item that could be used to commit ASB, this includes bikes and scooters, a failure to surrender the items may result in an offence.
This PSPO is in force for 3 years. What is covered under the PSPO? The order will prohibit any person from participating in or taking part in antisocial behaviour including (but not limited to) the following activities: No person shall within the restricted area: 1. Behave (either individually or in a group of 2 or more people) in a manner that causes or is likely to cause harassment alarm or distress to a member of public. This includes the use of E-Scooters. 2. Ingest, inhale, inject, smoke, possess or otherwise use controlled or intoxicating substances. 3. Sell or supply controlled or intoxicating substances. 4. No person shall within the restricted area refuse to stop drinking alcohol or hand over any containers (sealed or unsealed) which are believed to contain alcohol, when required to do so by an authorised person. 5. Loitering by persons in council housing blocks and estates (including but not limited to any stairwell, lobby area, and communal balconies) causing or likely to cause nuisance, intimidation, harassment, alarm or distress or using or dealing drugs directly or indirectly causing damage or other ASB. 6. Loitering by persons at any retail premises causing or likely to cause nuisance, intimidation, harassment, alarm or distress or using or dealing drugs directly or indirectly causing damage or other ASB. A breach of the PSPO could mean a Fixed Penalty Notice of a £100 fine. Or this could lead to an arrest, and/or court action if the behaviour persists which could lead to a fine of up to £1000.
