Public Space Protection Order


Good afternoon Resident 

 

We are approaching the end of the first year of the new Public Space Protection Order (PSPO) which came into force on 15th October last year.  

I wanted to share this information with you, as my colleagues have had a lot of questions from members of the public.  

You may already know, there is a red area which covers the town centre, which is an area where there is a prohibition of alcohol.  

We have powers designated to us by North Yorkshire Council to allow us to enforce the PSPO.  

If a subject is drinking alcohol within the red area, we can make the request for them to cease drinking. If they fail to do this, then they are in breach of the PSPO, which results in a fixed penalty ticket of £100 which is issued by the Council.  

If the subject is in the blue zone, which covers most of Scarborough, then it only prohibits the consumption of alcohol when anti-social behaviour is occurring. This includes behaviours which are causing or likely to cause harassment, alarm or distress.  

As an example, you can sit on the beach, chill out and watch the sunset with a glass of wine or a can of beer (other drinks are available) but you can’t be causing a disturbance whilst throwing your rubbish all over and shouting obscenities at everyone.  

We will also give a fixed penalty ticket to anyone we find urinating or defecating in a public place.
