We wanted to share a quick update about dangerous driving in your area. Please be assured we’re working to keep everyone safe. During the summer months there is often an increase in reports of anti-social and reckless driving and we are continuing to patrol and intervene wherever possible to address this.
A recent change in the law regarding antisocial driving means we can now seize vehicles used in manner causing alarm, distress or annoyance:
(1)Where a constable in uniform has reasonable grounds for believing that a motor vehicle is being used on any occasion in a manner which—
(a)contravenes section 3 or 34 of the Road Traffic Act 1988 (c. 52) (careless and inconsiderate driving and prohibition of off-road driving), and
(b)is causing, or is likely to cause, alarm, distress or annoyance to members of the public,
This is a pre-existing power where a warning needed to be issued before seizure but this requirement has now been removed meaning that where there is evidence of driving under the conditions outlined above, the vehicle can be seized by police.
This has been brought in to enable police to more effectively deal with anti-social behaviour and this simplified procedure will help us to tackle the issues head on.
